党内法规体系化的学理分析与路径考探

党内法规体系是中国特色社会主义法治体系的特殊环节和重要内容。党内法规体系化是中国共产党从制度层面落实依法治国、依规治党的内在要求。从理论分析看,党内法规体系化具有科学的内涵要义、典型的鲜明特质、明确的现实意蕴;从历史考察看,历经缘起、转折、突破这三个关键时期,党内法规制度建设已经从因时而立、因需而定、因势而变的探索方式转换到体系化建设的全面推进模式;从路径考探看,党内法规体系化是一项结构严密的系统工程,应以内容、结构、功能、适用这四个层面的体系化作为价值依归。

The system of inner-Party laws and regulations is the special aspect and important content of socialist legal system with Chinese characteristics.The systematization of inner-Party laws and regulations is the internal requirement of the CPC to implement the rule of law and governing the Party by rules from the system level.From the perspective of theory analysis,the systematization of inner-Party laws and regulations contains scientific connotation,typical feature,and clear meaning.From the perspective of history investigation,going through three key periods of origin,transition and breakthrough,the construction of inner-Party laws and regulations has changed from the exploration mode of establishing according to the time,determined by needs and changing according to the situation to the comprehensive promotion mode of systematic construction.From the perspective of path exploration,the systematization of inner-Party laws and regulations is a systematic project with strict structure,which should take the systematization of content,structure,function and application as the value orientation.
