Legal Effectiveness of Habermas'Theory and Its Philosophical Basis

在神学解释祛魅以后,现代西方社会中的法律体系陷入了合法性危机。不同的流派为化解合法性危机提出了不同的理论支撑,而哈贝马斯不同于其他流派,由实践理论转向交往理性,他将交往理性作为哲学基础,通过交往产生共识来解决法律内部的张力问题。哈贝马斯对于法律有效性理论的重构,对于其他哲学流派来说,是一种创新与超越,虽然其理论存在过于理想化的问题,但是对我国建设法治国家具有一定的理论借鉴价值。

After the disenchantment of theological interpretation,the legal system in modern western society fell into a crisis of legitimacy.Different schools put forward different theoretical support for resolving the crisis of legitimacy,while Habermas,different from other schools,changed from practical theory to communicative rationality.He took communicative rationality as the philosophical basis to solve the tension problems within the law by reaching consensus through communication.Habermas'reconstruction of the theory of legal validity is an innovation and transcendence for other philosophical schools.Although his theory is a bit too ideal,it has certain theoretical reference value for us to build a country ruled by law.
