摘要
当下我国职务发明制度在标准界定、权利归属分配与报酬的规定上存在一些问题,导致单位对于职务发明的利用效率不高,员工创新积极性不足,不利于我国科技高效快速发展。英国、法国、美国在职务发明制度上有各自的特色,以上各国的规定对于我国职务发明制度有一定的借鉴意义,可作为我国立法改进的参考。
There are still some problems on the standards,rights ownership and remuneration regulations in current service invention system in China,which results in the inefficient use of service inventions by the enterprise and insufficient innovation enthusiasm for employees.This won’t benefit the efficient and rapid development of technology in China.Some countries,like Britain,France,and the United States,have their own characteristics in the system of service inventions,which could be significant and meaningful for the legal system of Chinese service inventions and serve as a reference for the improving of legislation in China.
