合同法基本精神的新发展——以我国民法典为视角

The New Development of Basic Spirit of Contract Law--From the Perspective of China's Civil Code

合同法作为一个古老的法律部门,在现代社会焕发出勃勃生机,源于合同法基本精神突破了以合同自由为中心的封闭体系,构建起了以合同自由、合同正义、诚实信用、促进交易为基本精神的多维精神体系,并倾于向限制合同自由、追求实质正义、着重诚实信用等方面发展。我国民法典的编纂在现行法律基础上进行适度修订,坚持并贯彻了合同法的基本精神,确保了合同规则稳定性与连贯性,及其与民法典其他规则的契合性。

As an ancient legal Contract Law department,coruscates give new vitality in modern society.The basic spirit of contract law breaks through the closed system centered on the freedom of contract,constructs a multi-dimensional spiritual system based on the spirit of freedom of contract,justice of contract,honesty and credit,and promotion of trade,which is inclined to restrict the freedom of contract,pursue substantive justice,and focus on honesty and credit.The compilation of China's civil code is revised moderately on the basis of the existing law,which adheres to and carries out the basic spirit of contract law,ensures the stability and consistency of contract rules and their compatibility with other rules of civil code.
