论密里本德国家法哲学思想的整体意蕴及其启示

On the Whole Implication and Enlightenment of Miliband’s National Law Philosophy

"工具主义"是对密里本德国家理论的简单化总结,应当从更为基础整体的法哲学层面理解密里本德的国家理论。惟其如此,才能更全面深刻地解读密里本德的国家理论,挖掘其所蕴含的时代意义和价值。本文分别从作为理论批判主义的国家法哲学、作为权力实证主义的国家法哲学、作为制度建构主义的国家法哲学等三个角度解读了密里本德的国家理论。探寻密里本德国家法哲学思想的整体意蕴,总结其深层现实启示,可以增强中国特色社会主义的道路自信、理论自信、制度自信和文化自信。

"Instrumentalism"is a simplistic summary of Miliband’s national theory,which should be understood from a more basic and overall legal philosophy level. Only in this way can we have a more comprehensive and profound understanding of Miliband’s national theory and tap its implication of the times and value. This paper reinterprets Miliband’s national theory from three perspectives: the national philosophy of law as a theoretical criticism,the national philosophy of law as a power positivism,and the national philosophy of law as a system constructivism. Exploring the overall meaning of Miliband’s national philosophy of law and summarizing its deep realistic enlightenment can enhance the road confidence,theoretical confidence,system confidence and cultural confidence of socialism with Chinese characteristics.
