关于规范招标项目考察的若干思考

在我国招标活动中存在一种现象,即一些项目,采购人在招标前已经有了意向单位,想通过招标程序来使自己的“意向”变成合法结果,如果经过招标,恰好是意向单位成了第一中标候选人,则会按照招标程序顺利确定其为中标人,如果第一中标候选人不是自己意向的中标人,则要对第一中标候选人进行所谓的考察,以种种理由将第一中标候选人淘汰,使其意向的供应商中标,或废掉后重新招标。此种做法常常引发质疑和投诉。

In China’s bidding activities,there is a phenomenon,that is,some projects have intention units before bidding,and they want to make their“intention”become legal result through the bidding process.If the intention unit becomes the first successful candidate after bidding,it will be determined as the successful bidder according to the bidding procedures.If the first successful candidate is not the one who intends to win the bid,the so-called investigation shall be conducted on the first successful candidate,and the first successful candidate shall be eliminated for various reasons,so that the intended supplier can win the bid or invite bids again after being abandoned.This practice often raises questions and complaints.
