第三方参与不起诉案件公开审查机制创新的目的在于促进检察办案工作透明化,增强司法公信力,在赋予检察官办案决定权的同时,对不起诉裁量权进行有效监督。通过解读第三方参与不起诉案件公开审查的现实制度背景,在深入考察2017年7月迄今上海市闵行区人民检察院相关制度试点情况的基础上,对本项制度运行效果进行客观评测并就其完善路径作必要探讨,有助于"不起诉制度"诉讼价值的充分发挥。

The purpose of the innovation of the mechanism of third party’s participation in open evaluation of non-prosecution cases is to propel the transparency of the procuratorial work,enhance the judicial credibility,and to endow procurators with the decision-making power to handle cases,meanwhile,to effectively supervise their discretion to dismiss cases.By interpreting the realistic mechanism of the third party’s participation in the open evaluation of non-prosecution cases,and based on the in-depth investigation into the relevant pilot systems in People’s Procuratorate of Minhang,Shanghai since July 2017,the writer objectively evaluates effects of operating this mechanism and makes necessary exploration into its improvement methods,which is conducive to the full play of the litigation value of the"non-prosecution mechanism".
