统一法律适用标准的共识性进路——兼论作为制度的法官学院

A Consensus Approach to Unify Judicial Decision Standards:Also on the Institutional Function of Judges Academy

“统一法律适用标准”对于深化司法体制改革之基本目标的实现,具有内在构成性意义。基于客观标准和主观标准的不同认识,可以区分统一法律适用标准的外在进路和内在进路。目前我国司法改革采取一种外在进路,这一进路忽视了法官在标准形成过程中的内在作用,由此,应走向一种统一法律适用标准的共识性进路,充分重视法官及其共同体在司法共识形成中的主导性作用。在制度上,法官学院可以成为法官共同体形成的重要制度载体。

“Unifying judicial decision standards”can take an important and even a constitutive role in realizing the basic goal of judicial system reform in China.Based on the different understandings of objective standards and subjective standards,it is possible to distinguish between external and internal approaches to unify judicial decision standards.At present,China adopts an external approach to unify judicial decision standards.This approach ignores the intrinsic role of judges and their community in shaping the judicial decision standards.Therefore,we should move towards a consensus approach to unify judicial decision standards,and pay full attention to the leading role of judges and their communities in the formation of judicial consensus.And the Judges Academy can bear an important institutional function in forming the community of judges.
