在专利侵权诉讼中,权利要求的合理解释和被诉产品的正确认定分属于法律问题和事实问题,但二者有时交织在一起而难以厘清,不同的法官可能会产生不同的印象和认识,导致特征比对和侵权判定的结论大相径庭。本文通过两个关联案来说明方法特征对产品权利要求的限定作用、如何正确解释权利要求和认定被诉产品,确保对原被告双方做到不枉不纵。

In deciding patent infringement,reasonable claim construction relates to application of law while correct description of the accused product involves fact finding.But sometimes they are mingled together and cannot be separated,which may cause different judges to have different impressions.Accordingly,the results of comparing features and deciding infringement could be contrary.This paper addresses how product-by-process is identified,and how to interpret claims and describe the accused product in a correct way,so as to treat the plaintiff and defendant fairly.
