监察权与检察权的衔接路径研究——以公安执法监督为视角

Research on the Link between Supervisory Power and Prosecutorial Power—from the Perspective of Police Law Enforcement Supervision

结合公安执法监督实际,以监察权与检察权的启动顺序为逻辑起点,可以将监察权与检察权的衔接路径分为三个维度:监察权运行过程中的监检衔接,检察权运行过程中的检监衔接,检察权与监察权运行的双向衔接。监察权与检察权的衔接,应当坚持依法独立行使职权原则,完善互相配合、互相制约的各项机制,形成监督合力。

Combined with the reality of police law enforcement supervision,taking the initiation sequence of supervision and prosecution as the logical starting point,the connection path of supervision and prosecution can be divided into three dimensions:the connection of supervision and prosecution in the process of supervision,the connection of prosecution and supervision in the process of prosecution,and the two-way connection of prosecution and supervision.The connection between supervisory power and prosecutorial power should adhere to the principle of independent exercise of power according to law,improve the mechanisms of mutual cooperation and restriction,and form a joint force of supervision.
