大数据条件下任务式指挥的侦查运用研究

Application of Mission-based Command of Criminal Investigation under Conditions of Big Data

大数据背景下,犯罪形势发生了诸多变化,进而呼唤刑事侦查领域的变革。分析以科层制理论为支撑的传统侦查组织结构在大数据时代受到的冲击,并参考作为美军目前主要指挥方式的任务式指挥,从集中数据信息资源、构建扁平化的侦查指挥体系、尝试使用任务式命令、构建领导意图的共享机制以及推动上下级的相互信任等五个方面为我国刑事侦查组织形式的变革提供一种可行的思路。

In the context of the big data era, the crime situation has been undergoing many changes, thus calling for the revolution in criminal investigation. This paper analyzes the impacts of the big data on the traditional structure of criminal investigation organization based on the hierarchical system theory, refers to the mission-based command which is the main command mode of the US military, and puts forward feasible ideas for the reform of the organizational structure of criminal investigation, including centralizing data and information resources, building a flat investigative command system, trying to use mission-based command, building leadership sharing mechanisms, and promoting mutual trust between superiors and subordinates.
