新旧法律全球化的谋略与中国应对

The Strategies for the Old and New Legal Globalization and China's Response

旧有的法律全球化是西方发达国家攫取世界霸权在法律上的反映,表现在法律上的谋略为西方法律霸权主义。在世界多极化趋势下,新兴发展国家和弱小国家要求在全球化时代中维护自己的利益,表现在法律上的谋略为法律全球多极化。中国面对西方法律霸权主义要勇于捍卫自己的利益,对于符合自身利益与世界发展趋势的法律要能够包容。中国应当坚持弘扬传统法律文化,坚持和传递人类命运共同体价值观,加强法治现代化建设,提高对外法律沟通的能力,提高对霸权行为的反制能力,加强“一带一路”等多极化发展路径的法治化建设。

The old legal globalization is the western developed countries grab the hegemony reflecting on the law;the strategy isWestern Hegemonies of Law.Under the trend of multi-polarization of theworld,the emerging developing countries and small countries require to maintain their own interests in the era of globalization,the strategy is the Global Multi-polarization of Law.And as one of the emerging developing countries,China in the face of such legal globalization strategy,facing up to the western hegemony of law should defend its own interest,it should accommodate the law which can meet their own interests and the developing trend of law.China should carry forward its traditional legal culture,uphold and pass on the values of the community with a Shared future for mankind,strengthen the modernization of the rule of law,improve its ability to communicate with foreign laws,improve the ability to counter hegemonic behaviors,and strengthen the rule of law in multi-polar development paths such as"the Belt and Road Initiative"construction.
