From Unicorns to AI:Should Artificial Intelligence Replace Legal Professions?

人工智能应否取代法律职业,是一个具有价值性、整体性和根本性的问题。对此问题的回答存在外在主义和内在主义两种不同的理论观点。外在主义的观点主要采取事实性论证并从后果论的角度对人工智能取代法律职业进行功利主义的衡量,忽略了法律职业对人类生活所具有的内在伦理价值。与此相反,内在主义的观点从规范性的角度把法律职业看作是人类道德生活和道德实践不可分割的一部分,其关涉人类的主体性和生活意义,具有不可被放弃、不可被取代的伦理价值。法律职业对人类的生活具有内在的、构成性的和生成性的价值,值得被严肃认真地对待和珍视。

Whether legal profession should be replaced by artificial intelligence is a valuable,holistic and fundamental question.There were two different theoretical perspectives to answer this question.Externalism mainly adopts factual argument,and from the perspective of consequence,it makes utilitarian measurement on the replacement of legal professions by artificial intelligence,which ignores the inherent ethical value of legal professions to human life.On the contrary,internalism regards legal professions as an inseparable part of human moral life and moral practice from the perspective of normativity,which involve human subjectivity and life significance and have an irreplaceable ethical value.Legal profession has intrinsic,constructive and generative value to human life and is worthy of being taken seriously and valued seriously.
