体育赛事网络直播节目的法律保护模式探析

AN ANALYSIS ON THE COPYRIGHT PROTECTION PATH OF SPORTS EVENT LIVE WEBCAST

体育赛事本身的性质决定了难以将其明确划分到著作权法规定的作品范畴,所以利用网络实时盗播体育赛事节目的现象层出不穷。这是困扰我国当前体育赛事网络直播著作权的难题,理论界与实务界现有的各种保护模式都不能很好地进行解决。借鉴美、日等发达国家的做法,在注重作品独创性的同时,应当在具体实践中强化对作品实用性与经济性的考量。针对体育赛事的网络盗播行为,建议通过对广播组织权进行扩张解释予以有效规制。

Sports events do not fall within the scope of works stipulated by the copyright law,which is determined by the nature of sports events itself.As a result,the phenomenon of sports event broadcasting piracy via live webcast has appeared one after another.The copyright issue is a puzzle for sports event live broadcast in China,which cannot be dealt perfectly with the existing copyright protection modes in theoretical or practical sense.Reference can be drawn from the practices of developed countries such as the United States and Japan.The originality of the works should not be the only concern.The consideration of both utility and economy of the works should be stressed in practice.Therefore,sports event broadcasting piracy via live webcast is suggested to be regulated effectively by the right of broadcast organization and its expanded explanation.
