公法视域下的信用承诺及其规制研究

Research on Credit Commitment and Its Regulation under the Vision of Public Law

在构建社会信用体系建设的大背景下,针对公民个人、组织所设定的信用承诺被广泛运用于行政审批、登记、救助等各个领域,且贯穿事前、事中、事后所有环节。在功能定位上,信用承诺有利于提高规制效率,实现多元共治,亦与行政审批制度改革的目标相契合。在法律属性上,信用承诺并非独立的行政行为,而是信用规制活动中不可或缺的环节之一。为了促进信用承诺合法、有序运行,需要在明确规范依据、细化制度设计、理清救济路径的基础上,协调好信用承诺与其他规制方式间的关系,完善信息公开制度与多元互动机制。

In the context of building a social credit system,credit commitments set for citizens and organizations are widely used in various fields such as administrative approval,registration and rescue,running through all links before,during and after the event.In terms of functional positioning,credit commitment is conducive to improving the efficiency of regulation and achieving multiple co-governance,and it is also in line with the goals of the reform of the administrative approval system.In terms of legal attributes,credit commitment is not an independent administrative act,but one of the indispensable links in credit regulation activities.In order to promote the legal and orderly operation of credit commitments,it is necessary to coordinate the relationship between credit commitments and other regulatory methods on the basis of clear normative basis,detailed system design,and clarification of relief paths.At the same time,the information disclosure system and multiple interaction mechanisms should be improved.
