摘要
新时代依法治国战略给我国法律专业学位研究生教育带来了前所未有的发展空间与机遇,也对法治人才培养提出了新的挑战和要求。如何实现法律专业学位人才培养与法律职业资格的良好衔接,实现法治人才供给端与需求侧的良好衔接,以适应新时代全面依法治国战略需要,是当前亟需解决的法学教育领域的重大问题。本文深入分析新时代背景下法律专业学位研究生教育存在的问题,在借鉴国内其他专业学位与职业资格衔接经验以及美、德、日三国法律职业资格制度的基础上,从招生、培养、体制机制等方面研究探索法律专业学位人才培养与法律职业资格衔接的路径,并在西南政法大学法律专业学位研究生教育实践中开展了有益探索,以期更好地引导法律专业学位研究生教育健康发展,为全面推进依法治国提供人才保障。
The strategy of the rule of law in the new era has brought unprecedented development space and opportunities to the graduate education of law majors in China.At the same time,it also poses new challenges and requirements for the education of legal talent serving for the rule of law.There are a series of problems in the field of legal education that needs to be solved urgently-how to achieve a good connection between the training of legal professional degree talents and legal professional qualifications,how to achieve a good connection between the supply side and the demand side of the rule of law talents,and to adapt to the new era of comprehensively administering the country according to the law.This article analyzes in depth the problems existing in the postgraduate education of law majors in the new era.Based on the experience of other professional degree and the legal professional qualification system in the United States,Germany,and Japan,the author researches and explores the path of the training of legal professional degree talents and legal professional qualifications from the aspects of enrollment,training,and institutional mechanisms.On this basis,the author has carried out useful explorations in the practice of law degree graduate education at Southwest University of Political Science and Law in order to better guide the healthy development of law degree graduate education and provide talent guarantee for the comprehensive promotion of governing the country according to law.
