中国特色社会主义法治人才培养中的职业道德教育——法学专业教育的反思

Occupational Ethics Education in the Cultivation of Socialist Rule of Law Talents with Chinese Characteristics——Rethinking of Law Professional Education

习近平总书记提出“德法兼修,以德为先”的教育理念,对我国新时代中国特色社会主义法学教育具有重要的指导意义。中国特色社会主义事业进入了新时代,人民群众对美好生活、公平正义的需求向法律人提出了更高要求。一方面是人民群众对公平正义更急迫的需求;另一方面却是法律职业不能满足法治社会的整体发展,其中主要表现为法律人的职业道德素养较为滞后。法学教育作为法治人才培养的一个关键环节,对于法科学生德性不足的影响作用无法回避。法学人才培养中普遍存在重法轻德的倾向,在人才培养理念、课程体系设计、教学内容方法等方面均有着不同程度的表现。为满足新时代法治建设事业对法律人才的新要求,必须解决法治人才培养中德法不平衡的问题,强调德法兼修,优化培养理念,重塑课程体系,改进教学方法,构建新时代中国特色社会主义法治人才培养中的职业道德教育。

General Secretary Xi Jinping put forward the educational concept of“emphasizing both virtue and Law,and virtue is the first”,which has important guiding significance for socialist legal education with Chinese characteristics in the new era.The cause of socialism with Chinese characteristics has entered a new era,and the people’s demand for a better life,fairness and justice has raised higher demands on legal persons.On the one hand,the people's needs for fairness and justice are more urgent.On the other hand,the legal profession cannot meet the overall development of the rule of law society.The main manifestation is that the legal literacy of legal persons is lagging behind.There are many reasons why legal professional ethics cannot meet the development needs of the rule of law society.However,as a key link in the cultivation of the legal talent serving for rule of law,legal education has various drawbacks,and the influence of the lack of virtue of law students cannot be avoided.There is a general tendency to focus on the law and morality in the cultivation of legal talents,and there are different degrees of performance in terms of personnel training concepts,curriculum system design,and teaching content methods.In order to meet the new requirements of legal talents in the rule of law construction in the new era,we must solve the problem of unbalanced morality and law in the cultivation of rule of law talents,emphasize the reform of morality and law,optimize the concept of training,reshape the curriculum system,improve teaching methods,and constructing occupational ethics education in the cultivation of rule of law talents with social characteristics with Chinese characteristics in the new era.
