摘要 教育法律体系是一个由存在等级差异、互相联结的教育法律规范构成的统一体,通常由效力位阶、调整对象、功能作用三个维度构成。“一带一路”沿线国家的教育法律体系已经形成了以效力位阶为导向的纵向基础、以调整对象为导向的横向构成、以功能作用为导向的工具之用等基本特征。当前,我国正处于全面依法治教的关键期,借鉴“一带一路”沿线国家教育法律体系的基本经验,我国教育法律体系仍需在明确价值定位、推动部门法体系化建设、扩展立法领域等方面不断完善。 The Education Law System is a unified body composed of educational legal norms.This unified body is hierarchically different and interconnected.It usually consists of the legal effect rank,the horizontal composition oriented by the regulative target,and the value development oriented by function.The Education Law Systems of the countries along the“Belt and Road”have formed the basic characteristics of vertical foundation of the legal effect rank-orientation,the horizontal composition oriented by the regulative target,and the utilitarianism of the value development oriented by function.At present,our country is in the critical period of rule of law and great changes happened in the realm of legal education.Learning from the experience of the education law system of the countries along the“Belt and Road”will help China’s education legal system for the improvement of its value position,promotion of the systematization of departmental laws,and expand the field of legislation.
