Aspects of the Civil Code:Its Chinese Character,Practicability and Timeliness

我国民法典作为一部固根本、稳预期、利长远的基础性法律,具有中国特色、实践特色和时代特色。这些特色鲜明地体现在六个方面:民法典适应了维护基本经济制度、弘扬社会主义核心价值观的需要;民法典适应了人民群众对美好幸福生活的追求,强化了对人格权和财产权的保护;民法典回应了科技爆炸和科技进步带来的时代问题;民法典顺应了经济全球化的发展趋势,有效回应了市场经济的发展需要;民法典回应了资源环境恶化带来的环境保护和生态维护的时代问题;民法典回应了风险社会的时代需要,强化了损害预防和救济功能。民法典颁布后,应当准确理解、把握并实施好它。

As a basic law that reinforces the foundation,stabilizes the expectation and promises long-term benefits in legal sphere,China's Civil Code is characteristically Chinese,practical and timely.These characteristics are due to the following facts:the Civil Code meets the requirements of maintaining the basic economic system of China and carries forward the core values of socialism with Chinese characteristics;adapts to people's pursuit of a better and happy life;enhances the protection of people's personal and property rights;responds to the problems brought about by the rapid progress in science and technology;follows the trend of economic globalization;and effectively reacts to the development of market economy.On the other hand,the Civil Code also addresses the environmental and ecological problems as well as the social risks facing us today,and strengthens the functions of preventing damage and offering legal relief.Therefore,it is necessary for us to develop an accurate understanding of the Civil Code and apply it appropriately.
