论“通知-删除”规则对云服务器提供商的豁免--兼议“转权利人通知”

Study on Cloud Service Providers Exemption from Notice-and-Takedown Rule-Proposition on the Notice Forwarding Responsibility

《信息网络传播权保护条例》将“通知-删除”规则作为信息存储空间服务和搜索、链接服务两类网络服务提供者在信息网络传播权侵权中的免责条件。《侵权责任法》网络侵权责任条款将这一规则改造为归责条件,《民法典》延续并细化了该条款。云服务器提供商为云计算和用户接入互联网提供基础设施,与信息存储空间服务存在本质区别,云服务器提供商不应适用《条例》中的“通知-删除”规则。同时,云服务器提供商不能采取与“删除、屏蔽、断开链接”等效的“必要措施”,也不应承担“转权利人通知”义务,不应适用网络侵权责任条款中的“通知-删除”规则。云服务器提供商不仅应完全豁免“通知-删除”规则,更应豁免信息网络传播权侵权责任。

In the regulations of the Protection of the Right to Communicate Works to the Public over Information Networks,the notice-and-takedown rule is mandated as the liability exemption condition for the network service provider that provides information storage space or provides searching and linking services.This rule was introduced in the Tort Law of the PRC(Online tort liability clause)as a liability condition,the Civil Code of the PRC followed and specified it in a similar pattern.The cloud-computing service providers provide cloud-computing and access-to-the-internet services with fundamental infrastructure,which is quite distinct from the services with information storage space that leads to rules inapplicable to those service providers.Cloud service providers also cannot take necessary measures which are equivalent to the measures like deleting,shielding or disconnecting the link.And they should not bear the responsibility of notice forwarding.Hence,they should not be applied to the notice-and-takedown rule made in the online tort liability.In sum,cloud service providers should be exempted not only from the notice-and-takedown rule,but from any possible liability for copyright dissemination infringement,referring to the exemption clauses for automatic access services providers.
