论智慧检务在行政检察中的法治难题及其应对

On the Rule of Law Difficulties and Response in the Wisdom Procuratorial Work of Administrative Prosecution

行政检察的核心是对行政诉讼的监督,随着检察体制改革,机构的分立以及行政诉讼监督部门的独立,意味着检察机关对行政诉讼监督的重视及强化。智慧检务在检察工作中的应用,是“大数据+法学”的又一重大变革,将智慧检务应用到行政检察中能够促进行政诉讼监督的落实。然而,智慧检务在行政检察中的应用仍然存在一系列法治难题,主要表现为智慧检务案件适用范围的局限、审判标准的量化与自由裁量的矛盾、检察建议生成机制待考量、信息不畅导致行政检察执行监督受阻等方面。有鉴于此,应当合理界定智慧检务案件的适用范围、不断协调审判量化与自由裁量的矛盾,优化检察建议生成机制,构建信息共享,加强执行监督,以期实现智慧检务在行政检察中的有效应用。

The core of administrative prosecution is the supervision of administrative litigation.With the reform of the procuratorial system,the separation of institutions and the independence of the administrative litigation supervision department mean that the procuratorial organ attaches importance to and strengthens the supervision of administrative litigation.The application of wisdom procuratorial work in procuratorial work is another major change in“big data+jurisprudence”.The application of wisdom procuratorial work to administrative prosecution can promote the implementation of administrative litigation supervision.However,the application of wisdom procurat orial work in administrative prosecution still has a series of legal problems,mainly manifested in the limitation of the scope of application of smart prosecution cases in administrative prosecution,the contradiction between the quantification of trial standards and discretion,the mechanism for the generation of prosecutorial recommendations to be considered,The lack of information has led to the obstruction of the implementation of administrative prosecution and other aspects.In view of this,the scope of application of smart prosecution cases should be properly defined,the contradiction between trial quantification and discretion should be continuously coordinated,the mechanism for generating procuratorial recommendations should be optimized,information sharing should be established,and execution supervision should be strengthened in order to achieve the effectiveness of wisdom procuratorial work in administrative prosecution application.
