试论教育转化在邪教案件讯问中的作用

On the Role of Educational Transformation in the Interrogation of Cult Cases

当前邪教组织犯罪的新特点、新变化不仅给案件的讯问工作带来了诸多的新难点,还对案件讯问工作的策略、方法提出了新要求。在邪教案件中,讯问作为侦查取证的一项重要环节,不仅具有查明案情的重要作用,还应当兼顾教育犯罪嫌疑人、转化其邪教思想的功能。我国《关于取缔邪教组织、防范和惩治邪教活动的决定》中也提出了关于邪教治理要坚持“教育与惩罚相结合”的原则。应将教育转化适用于邪教案件讯问过程中,在获取真实供述的同时,争取转化被蒙骗的邪教信徒,促进对邪教的长久治理。

The new characteristics and new changes of cult’s current crime not only bring a lot of new difficulties to the interrogation work,but also put forward some new requirements to the strategy and method of case interrogation work.In cult cases,interrogation,as an important link in investigation and evidence collection,not only plays an important role in ascertaining the fact of a case,but also has the function of educating criminal suspects and transforming their“cult thought”.In addition,China’s“Decision on Banning Cult Organizations,Preventing and Punishing Cult Activities”also puts forward the principle of“combining education with punishment”in dealing with cult.The educational transformation should be applied in interrogation of cult cases.While obtaining the true confession,we should strive to transform the deceived cult believers and promote the long-term governance of cult.
