论青少年法治思维教育意旨与意识形态的复归 被引量:4

摘要 法治思维有自身的发展逻辑,由遵守到执行,再到推行法与规则的思维发展,演绎了思维在法治思索中由消极自由驶向积极自由的递进过程。法治思维教育在此基础上,从个人、社会和国家三个层面构筑了教育的三重愿景。然而,有的青少年却在教育理想与经验现实的差异性认知中,表现出了对教育内容的困惑与怀疑。面对青少年的困惑,仅以价值共识作为法律合法性来源来稳固法治的思想基础,并不能真正解决问题。法治思维教育只有转向经验世界,让价值共识借助意识形态的支持,才能连接理想与现实,解除青少年的困惑。求助于意识形态的法治思维教育,也因此复归了意识形态的目的论承诺,即法治思维教育亦要实现青少年对马克思主义思想、社会主义核心价值观以及国家民族的认同。 The Legal thinking has its own development logic,from the initial compliance to the implementation,and then to the implementation of the law,which deduces the progressive process of thinking from negative freedom to positive freedom in the process of thinking about the rule of law.On this basis,the education of legal thinking constructs the triple vision of education from the three levels of individual,society and country.However,teenagers are perplexed and doubted about the content of education in the different cognition between educational ideal and experience reality.In the face of the confusion of young people,it can’t really solve the problem to take value consensus as the source of legal legitimacy to stabilize the ideological basis of the rule of law.Only by turning to the experience world and making the value consensus supported by ideology can we connect the ideal with the reality and relieve the confusion of teenagers.The education of legal thinking relying on ideology also reverts to the teleological commitment of ideology,that is,the education of legal thinking should also realize the youth’s recognition of Marxism,socialist core values and the nation.
