我国地方治理法治化“落地”难题及其破解

The Problem and Solution of the Legalization of Local Governance in China

法治化是国家治理体系现代化的主导原则,地方治理法治化是推进新时代国家治理体系和治理能力现代化的重要引擎。然而,地方治理法治化在具体实践过程中“落地”难的问题突出,即政治、经济和法治的逻辑冲突导致地方治理法治化难以落到实处。其根源在于我国地方治理法治化在实践中忽视基层党组织建设,不重视地方参与主体的多元性和创造性,一些治理行为在经济和法治建设方面存在功利主义倾向。为此,需要从制度分权的角度着力打造地方治理法治化的制度基础,并以此构建以法治型党组织建设为引领,地方政府、市场主体以及社会力量共同参与的地方治理法治化多元共治格局,最大限度地凝聚共识,增强治理合力,提升国家治理能力。

The rule of law is the leading principle of the modernization of national governance system,and the legalization of local governance is an important engine to promote the modernization of national governance system and governance capacity in the new era.However,in the process of local governance legalization,the problem of"landing"is prominent,that is,the logical conflict between politics,economy and the rule of law leads to the difficulty in implementing the legalization of local governance.The root of the problem lies in the fact that in the practice of local governance the construction of grass-roots Party organizations is ignored and the diversity and creativity of local participants are neglected,and some governance behaviors tend to be utilitarian in economic and legal construction.Therefore,it is necessary to focus on building the institutional foundation of local governance legalization from the perspective of system decentralization,and build a diversified co governance pattern of local governance legalization,which is led by the construction of rule of law Party organizations and participated by local governments,market players and social forces,so as to reach consensus to the maximum extent,enhance governance force and enhance national governance capacity.
