论职务犯罪监察调查程序中刑事证据规则的构建

Construction of Criminal Evidence System in the Supervision Procedure of Duty Crime

职务犯罪监察调查程序中刑事证据规则的构建属于监察体制改革的核心议题。《监察法》和《刑事诉讼法》及其解释均为制度构建的规范依据。在证据范围方面,应遵循“宽进严出”的规则,保证纪检监察机关在职务犯罪调查过程中收集的材料均作为刑事证据出示;在证据收集方面,应遵循“就高不就低”的规则,提高纪检监察机关调查取证的法治水平;在非法证据排除方面,应以监察改革为契机,推动非法言词证据排除规则的进步,并建立有效的非法实物证据排除规则。

The construction of the criminal evidence system in the duty crime supervision procedure belongs to the core issue of the supervision system reform.In terms of the scope of evidence,the principle of"easy to come in but hard to get out"should be followed to ensure that the materials collected by the discipline inspection and supervision organs during the investigation of duty crimes are presented as criminal evidence;with regard to the collection of evidence,the principle of"following the higher standard rather than the lower"should be abided by to improve the rule of law in the investigation and evidence collection of the discipline inspection and supervision organs;in the exclusion of illegal evidence,the supervision reform should be taken as an opportunity to promote the progress of the rules for the exclusion of illegal verbal evidence and to establish effective rules for the exclusion of illegal physical evidence.
