将经营权从原有的土地承包经营权中分离,从而实现土地的集中高效利用,是"三权分置"的重要目标。修订后的《农村土地承包法》和今年5月份刚出台的《民法典》都明确规定了"土地经营权"这一概念,为土地经营权制度的建立奠定了基础。与承包权分离后的经营权,具有鲜明的用益物权特征,未来的土地经营权制度,应明确这一属性,并对经营权的权能、效力及融资担保方式等内容作全面的制度设计。

Separating management rights from the right to land contractual management is the most important goal of three rights division.The revised Law of Rural Land Contract and The Civillaw Code which was enacted in May this year both regulate land management rights.This will lay the foundation for constructing the system of land management rights.Land management rights have distinct characteristics of usufruct,we should definite its nature in the future system,meanwhile,we should definite its powers,functions and the methods of security.
