摘要
自20世纪末以来,受全球化和信息化的强力驱动,劳动力市场灵活化在西方国家成为不可逆转的趋势,这些国家逐步改革劳动法以放松对于劳动力市场的管制。劳动法以保护劳动者权利为主旨,会限制劳动力市场灵活性,但劳动法不否定甚至维护劳动力市场灵活性,这种纠葛关系使放松劳动法管制的改革难免具有高度复杂性与争议性。德、荷、法、英等西方国家的劳动法改革在放松管制的相同目标之下,采取了有差别的具体改革措施,并体现出不同的改革思路与特点,相关的探索与实践提供了有借鉴价值的经验。就我国而言,未来劳动法改革的基本策略应包括:以公平与效率的平衡为目标导向,运用社会对话机制协调劳雇利益,将"灵活"与"安全"的联结作为改革的进路。
Since the end of last century,driven by globalization and information technology,the labor market flexibility has become an irreversible trend in western countries.These countries have gradually reformed labor laws to loosen the control of labor market.Labor law aims to protect labor rights and restrict labor market flexibility,but labor law does not deny or even maintain labor market flexibility.Such entanglement makes the reform about labor law deregulation highly complex and controversial.Under the same goal of deregulation,labor law reform in Germany,Netherlands,France,Britain and other western countries adopted different reform measures,reflecting different reform ideas and characteristics.Relevant exploration and practice can provide valuable experiences for reference.As far as China is concerned,the basic strategies of labor law reform should include:taking the balance between fairness and efficiency as the goal orientation,using the social dialogue mechanism to coordinate the interests of labor and employees,and taking the connection between“flexibility”and“security”as the way to reform.
