探析“一带一路”知识产权风险防范应对机制

Research on the“the Belt and Road”intellectual property risk prevention and coping mechanism

随着全球经济一体化的不断加深和“一带一路”倡仪的贯彻落实,越来越多江苏企业走出国门。江苏企业在与“一带一路”沿线国家开展贸易合作,进行海外投资经营时难免要面临区域性的知识产权风险。因此,江苏企业参与“一带一路”沿线国家建设的知识产权风险防范应对机制研究就显得尤为重要。文章从知识产权风险规避策略、规避当地宗教约束、借助海关守护、第三方知识产权维权援助以及发挥政府职能5个方面探析知识产权风险防范应对机制,以期江苏乃至全国企业在“走出去”时能够有效防范知识产权风险,为更好解决知识产权纠纷,有力维护企业包括知识产权在内的合法权益助力。

With the deepening of global economic integration and the implementation of“the Belt and Road”initiative,more and more Jiangsu enterprises go abroad.Jiangsu enterprises face regional intellectual property risks when they conduct overseas investment and operation in their trade cooperation with“the Belt and Road”countries.Therefore,it is very important to study the intellectual property risk prevention and coping mechanism of Jiangsu enterprises when they take part in the construction of“the Belt and Road”countries.This paper explores the mechanism of intellectual property risk prevention and coping mechanism from five aspects:the strategy of avoiding intellectual property risk,circumvention of local religious restriction,the aid of customs protection,the assistance of intellectual property protection from third parties and the exertion of government functions.It is expected that enterprises in Jiangsu and even the whole country can effectively guard against intellectual property risks in the process of“going out”,better resolve intellectual property disputes and vigorously protect their legal rights and interests including intellectual property rights.
