摘要
自我国网络食品安全违法行为查处办法出台以来,网络食品安全问题已纳入公共政策议程,但对于微商所销售的食品安全监管尚处在探索之中。近年来微商销售的食品引发的安全问题日渐增多,其中微商所销售的劣质水果、“私房月饼”、假冒进口奶粉、伪劣减肥药品等食品,严重威胁到公民的健康。微商销售食品安全监管面临着违法取证难、维权意识宣传缺失、市场准入制度不当、交易信息不对称、保障机制缺失、权责划分笼统等功能障碍。通过对微商食品安全监管现状进行研究,采用多中心治理理论从政府、市场、社会三方面进行分析,提出从“三效联动”层面探讨政府、市场、社会应如何共同监管微商食品安全问题。
The issue of online food safety has been included in the public policy agenda since the introduction of online food safety supervision and punishment measures.However supervision on micro-commercial sales is still under exploration.In recent years,the food safety issues caused by micro-commerce are on the increase.Based on the difficulty in obtaining illegal evidence,lack of publicity of rights protection awareness,improper market access system,asymmetric trading information,lack of guarantee mechanism and unclear division of rights and responsibilities,and adopting the multi-center governance theory,this paper explores the methods for the government,market and society to jointly supervise micro-commerce food safety from the perspective of"three-effect linkage".
