国有地勘单位矿业权合作勘查风险研究

Research on the Risk of Cooperative Exploration of Mining Right in State-owned Geological Exploration Units

文章通过梳理近年来部分国有地勘单位与社会资本合作产生的纠纷和潜在风险,结合有关案例,分别从履约过程、政策变动、横向主管部门间信息协调三个方面分析其存在问题及风险,并提出以下意见和建议:(1)对合作方进行尽职调查,尽量规避履约风险;(2)与各合作方充分沟通,注意规避政策、法律等风险;(3)及时与有关主管部门沟通,规避部门间政策不协调造成的重大风险。

The paper reviews the disputes and potential risks arising from the cooperation between some state-owned geological exploration units and social capital in recent years.Based on relevant cases,the paper analyzes the existing problems and risks from three aspects of performance of contracts,policy changes and information coordination between horizontal competent departments,and puts forward the following opinions and suggestions:(1)to conduct due diligence on partners and try to avoid performance risks;(2)to communicate fully with every partners and pay attention to avoid risks of policies and laws;(3)to communicate with relevant competent departments in time to avoid major risks caused by policy incongruity between departments.
