大数据技术减少刑事司法体系偏差的分析——基于新冠肺炎疫情背景 被引量:1

摘要 在刑事司法体系中,引发司法偏差的主要原因包括种族、性别、疾病等歧视和其他暂时性因素,大数据技术能够减少因各种偏见造成的司法偏差。结合现有文献和新冠肺炎疫情下的刑事司法体系现状可以发现,疫情期间的侦查、审判和执法方式秉持从重、从快、从严的原则。运用大数据技术为疫情期间的快速执法和审判提供技术支撑,不但能降低疫情期间执法行为造成的疫情扩散,保护执法人员,还能够有效地保障人民群众的生命、财产安全,有力地震慑违法犯罪分子,有效阻止违法犯罪活动借由疫情泛滥。 In the criminal justice system,the main causes of judicial bias include discrimination such as race,gender,disease,and other temporary factors. Big data technology can reduce the judicial bias caused by various prejudices. Combining the existing literature with the current situation of the criminal justice system under the NCP epidemic situation,we can find that the investigation,trial,and law enforcement meth-ods during the epidemic period adhere to the principle of being important,expeditious and strict. Using big data technology to provide technical support for rapid law enforcement and trial during the epidemic situa-tion can not only reduce the epidemic spread caused by law enforcement during the epidemic situation,protect law enforcement personnel,but also effectively ensure the safety of life and property of the people,effec-tively deter criminals and effectively prevent the spread of illegal and criminal activities through the epidemic situation.
