中国环境监管模式的反思与重构

Reflection and reconstruction of environmental supervision mode in China

本文从中国环境监督管理模式的反思入手,深入阐述了用权利制约权力的限制性,而后又对强制性监管手段的局限性进行了简单的分析。在此基础上,为了确保中国环境监管工作的顺利发展,又从建立健全第三方环境角度管理模式以及建立自我监督管理模式两方面,仔细阐述了中国环境监管模式的重构策略。

Starting from the reflection of China’s environmental supervision and management mode,this paper expounds the limitation of restricting power with power,and then makes a simple analysis of the limitation of compulsory supervision means.On this basis,in order to ensure the smooth development of China’s environmental supervision,this paper elaborates the reconstruction strategy of China’s environmental supervision mode from two aspects:establishing and improving the third-party environmental management mode and establishing the self supervision management mode.
