海涂围垦生态补偿主体探讨:一个研究框架

Discussion on the Main Body of Ecological Compensation for Coastal Reclamation:A Research Framework

鉴于海涂围垦利益关系和海涂资源权属的复杂性,提出海涂围垦生态补偿权责主体的确定需要从相关利益者识别、资源权属分析和生态补偿原则等三个方面综合考虑。以杭州湾新区海涂围垦生态补偿为例,按照相关利益者分析法、资源权属分析法,结合补偿原则,确定该区域海涂围垦生态补偿主体和受偿主体,并提出构建海涂围垦生态补偿基金作为二者之间的虚拟受偿主体用以梳理清生态补偿主体和受偿主体权责关系的思路。

In view of the complexity of the relationship between the interests of the reclamation and the ownership of the resources,it is proposed that the determination of the main body of the rights and responsibilities of the ecological compensation for the reclamation should be comprehensively considered from three aspects:the identification of the relevant stakeholders,the analysis of the ownership of the resources and the principles of the ecological compensation.Taking the coastal reclamation ecological compensation of Hangzhou Bay New Area as an example,according to the stakeholder analysis method,resource ownership analysis method and the compensation principle,the main body of ecological compensation and the main body of compensation are determined.It also puts forward the idea of constructing the ecological compensation fund of coastal reclamation as the virtual compensation subject between the two to sort out the rights and responsibilities of the ecological compensation subject and the compensation subject.
