医保改革事业任重道远,在改革进程中必须始终坚持深入贯彻实施依法治国方略,从"法制"和"法治"两个维度全面推进医保法治建设,确保医保治理法治化。紧紧围绕全面推进依法治国的总目标,从我国实际出发,与推进国家治理体系和治理能力现代化相适应,确保改革始终在法治轨道范围内运行,实现良法善治。本文首先强调,以习近平新时代中国特色社会主义思想为指导,全面建立中国特色医疗保障制度。接着,分析了我国医疗保障法治体系的现状及面临的困境。最后,对医保法治建设进行了系统性、深层次思考,包括:整体规划以"基本医疗保障法"为主干的医疗保障制度体系;加快推动《中华人民共和国社会保险法》的立法修订;加快重点领域建章立制;自上而下开展规范性文件清理修订;建立统一的医保监管执法体制;强化依法行政理念提升医保治理能力等。

The reform of healthcare security has a long way to go.In the process of reform,we must always adhere to the strategy of ruling the country according to law,comprehensively promote the construction of the rule of law in healthcare security from the two dimensions of"legal system"and"rule of law",so as to ensure the legalization of healthcare security governance.Closely centering on the overall goal of comprehensively promoting the rule of law,proceeding from China’s reality,and adapting to the modernization of the national governance system and governance capacity,we should ensure that the reform always operates within the scope of the rule of law.This article first emphasizes that healthcare security should be established in China with the guidance of Xi’s socialist ideology with Chinese characteristics.Then,it analyzes the current situation and difficulties of the legal system of healthcare security in China.Finally,the paper makes a systematic and deep thinking on the legal construction of healthcare security,including the overall planning of the healthcare security system with the The Basic Healthcare Security Law as the backbone,and accelerating the promotion of the The Social Insurance Law of the People’s Republic of China.Then we should speed up the establishment of laws and regulations in key areas,clean up and revise normative documents from top to bottom,establish a unified healthcare security supervision and law enforcement system,strengthen the concept of administration according to law,and enhance the ability of medical insurance governance.
