我国特殊不起诉制度的审视与构想

Review and Conception of China’s Special Non-Prosecution System

从特殊不起诉制度的教义学分析入手,结合特殊不起诉制度的价值分析,从适用标准不明晰和救济制度缺失两方面对《刑事诉讼法》特殊不起诉制度进行审视,同时对我国特殊不起诉制度的完善提出构想,即明确适用条件和程序、扩大适用范围、完善相关的救济制度、完善被不起诉的犯罪嫌疑人的保护制度,以期对我国特殊不起诉制度的完善有所裨益。

Starting with the doctrinal analysis of special non-prosecution system,and combined with the value analysis of this system,this paper examines the special non-prosecution system from two aspects of unclear applicable standards and absence of relief system,and meanwhile puts forward the conception to perfect this system in China,which includes clarifying the applicable conditions and procedures,expanding its application,improving the relief system,and improving the protection system for suspects who are not prosecuted,so as to help the construction of China’s special non-prosecution system.
