摘要
水滴筹事件反映出我国网络慈善众筹平台存在诸多缺失,商业性平台和公益性事业之间的紧张关系致使慈善众筹平台的商业化倾向十分严重,这直接就导致慈善众筹平台在运行中存在信息严重不对称、合规管理缺失以及监管缺位等问题,解决之道是创新监管机制,有效切割商业组织与慈善众筹的关联,由公益组织来开展慈善众筹,同时强化平台的信息披露、通过信息规制工具提高监管效能,完善慈善众筹的内部合规管理。
TheShuiDiChou’s event reflects that there are very serious deficiencies in the online charity crowdfunding platform.The strained relation between the commercial platform and the public welfare causes the commercialization tendency of the charity crowdfunding platform,which directly leads to serious information asymmetry,the lack of compliance management and regulation in the operation of the charity crowdfunding platform.The solution is to set clear boundaries between the profit-making organizations and charity crowdfunding.Besides,empower public benefit organizations to operate the charity crowdfunding,strengthen the information disclosure of the platform,improve the regulatory efficiency through information regulation tools,and improve the internal compliance management of charity crowdfunding.
