依法治国视阈下共青团的软法治理

Soft Law Governance of the Communist Youth League from the Perspective of Rule of Law

在全面落实依法治国方略、推进国家治理体系现代化这两大时代背景下,基于软法治理展开的共青团法律问题研究,建构以团章为基础的团内法规体系已成为可能。共青团软法治理的提出顺应了社会主义民主法治建设的现实需要,具有内在必然性和外在必要性。新时代共青团的软法治理应构筑以理性为基础的法制思维,建立完善的软法实施与监督保障机制,形成软法与硬法相辅相成、混合而治的良性互动格局。

Under the background of fully implementing the strategy of governing the country in accordance with the law and advancing the modernization of the national governance system,it is possible to study the legal issues of China Communist Youth League(hereinafter referred to as CCYL)based on soft law governance and to construct a“legal system within the League”on the basis of the League Constitution.The proposal of soft law governance of CCYL conforms to the practical needs of building social democracy and rule of law which has internal inevitability and external necessity.The soft law governance in the new era should establish a rational-based legal thinking,set up perfect soft law implementation and regulatory safeguarding mechanisms,form a benign interactive pattern of a mixture of soft law and hard law,realize CCYL’s hybrid governance of soft law and hard law.
