法治政府建设是当下推进国家治理体系现代化的热点与难点问题,如何在国家内部形成广泛共识,是推进依法治国、建设社会主义法治国家的重要关注点,民主政治制度、市场经济、公民文化以及社会自治的培育与发展,是其中的关键制约因素。从国家治理(即自上而下的秩序构建)与权利诉求(即自下而上的利益表达)两个角度理解法治政府建设的理论逻辑,能够在决策者意图与民众合理诉求中寻找维持社会稳定发展的平衡点,为法治政府建设提供合理性来源。

The construction of a law-based government is a hot and difficult issue in promoting the modernization of national governance system.How to form a broad consensus within the country is a major concern for advancing the rule by law and building a socialist country under the rule of law.The cultivation and development of democratic political system,market economy,civic culture and social autonomy are considered to be the key constraint.Understanding the theoretical logic of government construction under the rule of law from the perspectives of state governance(top-down order construction)and rights requirements(bottom-up expression of interests)enables us to search the equilibrium point in maintaining the stable development of society from the intentions of policymakers and the reasonable demands of the people as well as provide a reasonable source for the construction of a law-based government.
