Research of Problem of Criminal Jurisprudence in Artificial Intelligence Technology

人工智能技术下刑法学存在着内部风险、外部风险等问题。由于一些刑法规章制度的不完善,给人工智能技术的应用带来很大风险。针对刑法学中存在的问题,提出应对人工智能技术下刑法问题的有效策略,如:统一罪刑法定工作准则、刑法重点保护公民信息安全、设定人工智能禁区,及时应对人工智能技术下的刑法风险。

There are internal and external risks in criminal jurisprudence in AI.The imperfect rules and regulations of criminal jurisprudence bring great risk for AI application.According to the problems in criminal jurisprudence,the research proposes the effective strategies,including uniforming the work principle of legally prescribed punishment for a specified crime,criminal law emphasizing the protection of citizens’information safety,setting AI forbidden zone,and timely responding to the risks of criminal law under AI.
