中国动漫产业知识产权一体化保护研究

On the integrated protection of intellectual property rights in China’s animation industry

近年来,在政府的大力扶持下,动漫产业逐渐成为提升国家软实力、对外推广中华文化的重要载体。但当下中国尚不完善的知识产权保护体系已不能适应这一发展潮流。健全中国知识产权保护体系需要从两方面出发:一是建立统一的知识产权保护法律体系,整合分立的知识产权领域立法,设立统一的知识产权法典,从法律层面对知识产权提供全面的、跨类别的一体化保护;二是优化行政管理体系,确定统一的知识产权行政管理与执法部门,减少职能交叉导致潜在政令冲突的可能,畅通政府对知识产权产业的管理与引导机制。

In recent years,the Chinese government has continuously increased its support for the development of China’s domestic animation industry,and promoted the animation industry to become an important carrier to enhance the country’s soft power and promote Chinese culture abroad.But at present,China’s imperfect intellectual property protection system has not been able to adapt to this development trend.There are two aspects to improve China’s intellectual property protection system:one is to establish a unified intellectual property protection legal system,integrate the separate legislation in the field of intellectual property,and provide comprehensive and cross category integrated protection for intellectual property from the legal level;the other is to optimize the administrative management system,determine a unified intellectual property administrative management and administrative law enforcement department,and reduce the possibility of overlapping functions and smooth government management and guidance mechanism.
