“套路贷”虚假诉讼案件的审查与识别——以民事检察监督为视角

Examination and Identification of “Routine Loan” False Litigation in Civil Prosecution--From the Perspective of Civil Procuratorial Supervision

“套路贷”是扫黑除恶专项斗争重点打击的犯罪类型,虚假诉讼多发于该类案件中,研究“套路贷”所涉罪名对民事检察监督案件的审查思路具有重要意义,在办理“套路贷”虚假诉讼监督案件中应注意与民间借贷纠纷的区分。“套路贷”犯罪的实质是通过民间借贷的合法外衣,非法占有他人财物,因此,在对民事检察监督案件审查中要牢牢把握住“以非法占有为目的”这一侵财犯罪本质特征,用足调查核实权,综合多种调查措施,全面、客观收集证据,综合审查、判断,以识别“套路贷”犯罪。另外,还应重视与公安机关的协作,借助公安机关侦查权优势,助推“套路贷”虚假诉讼案件的深入审查,精准监督。

“Routing loans”are the types of crimes that are focus of the special fight against gangsters,and false lawsuits are common in this type of cases.It is of great significance to study the crimes involved in“routing loans”in the examination of civil procuratorial supervision cases.In handling“routine loans”false litigation supervision cases,attention should be paid to distinguishing from private lending disputes.The essence of the“routine loan”crime is to illegally possess others’property through the lawful clothing of private lending.Therefore,in the review of civil procuratorial supervision cases,it is necessary to firmly grasp the essential characteristics of the crime of infringement of property for the purpose of illegal possession,use sufficient investigative verification power,integrate multiple investigative measures,comprehensively and objectively collect evidence,and comprehensively review judgment to identify“routine loan”crimes.In addition,we should also pay attention to the cooperation with public security organs,and take the advantages of public security organs’investigative power to facilitate the in-depth review and accurate supervision of false lawsuits of“routing loans”.
