《治安管理处罚法》立法问题刍议

The Dispute over the Legislation of Security Administration Punishment Law

我国《治安管理处罚法》存在处罚法定原则缺失,违反治安管理行为界定不明确,证据制度不够完善的问题。基于社会主义法律体系完善的原则和要求,对比刑法学罪刑法定原则,刑事诉讼法证据法学基本原理以及治安学学科体系建设等研究成果,结合公安工作实践存在的问题,需要在治安案件查处过程中确定处罚法定原则,对处罚法定原则的内涵和外延加以剖析、明确,并以此原则为逻辑起点,明确违反治安管理行为的构成要件,完善治安处罚证据制度,对治安处罚证据种类,收集证据主体合法性,证据排除规则进行分析,以期实现依法行政、合理执法的目的。

Based on the analysis of the draft texts of Security Administration Punishment Law and Security Administration Punishment Law,the author makes a deep study,and finds that there are some problems in the Security Administration Punishment Law of our country,such as the lack of statutory penalty principle,the unclear definition of violation of public security management behavior and the imperfect evidence system.Based on the principles and requirements of improving the socialist legal system,the author compares the research results of principle of legality of criminal law,the basic principle of evidence law of criminal procedure law and the construction of discipline system of administration and security,and combined with the problems existing in the practice of public security work,it is necessary to determine the statutory penalty principle in the process of investigating and dealing with public security cases,analyze and clarify the connotation and extension of statutory penalty principle,and take this principle as the logical starting point.Constitutive requirements,which violates the public security management behavior,improves the evidence system of public security punishment,analyzes the types of evidence of public security punishment,the legitimacy of collecting evidence subjects and evidence exclusion rules,in order to achieve the purpose of administration according to law and reasonable law enforcement.
