用户原创短视频的独创性

The Originality of User-Generated Short Videos

随着短视频应用的兴起,用户原创短视频吸引了大量优质流量,但也产生了以版权侵权为代表的诸多法律隐患。从短视频产生与样态切入,探讨用户作为短视频版权主体的适格性,以域外独创性标准为鉴对用户原创短视频的具体保护程度与范围进行分析,认为应以个案分析为主要认定方法、以整体“连续画面”为认定的主要客体、兼顾我国相关产业实际发展情况确定独创性门槛。据此提出了我国当前法制体系的应对路径,探究了契合短视频特点的独创性标准与配套规范,并对人工智能、区块链等短视频版权保护的重要技术手段进行了可行性论证。

With the quick spread of short video Apps,user-generated short videos attract a large amount of high-quality flow rate,but it also produces many potential legal risks as represented by copyright infringement.Starting from the analysis of the generation and the patterns of short videos,this paper explores the eligibility of users as the subject of short video copyrights,analyses the specific protection degree and scope for user-generated short videos based on the international standard of originality.It can be concluded that the determination of the threshold of originality in China should take case analysis as the main identification method,the overall“continuous picture”as the main object,and the actual development of relevant industries in China as a reference.Then this paper puts forward the response path of the current legal system in China,including formulating the originality standards and corresponding specifications that fit the characteristics of short videos as soon as possible,and demonstrates the feasibility of the important technical means of copyright protection for such short videos as artificial intelligence and Block-chain technology.
