社区矫正本质研究

On the Essence of Community Correction

目前学术界关于社区矫正本质的主要观点可归纳为五种,即社区刑罚执行说、非监禁刑罚执行说、刑罚执行与社会福利说、实施矫正和提供社会服务说和刑事执行说,但这些观点对社区矫正本质的认定都不够准确。从社区矫正实践和《社区矫正法》看,管制、宣告缓刑、假释和暂予监外执行的罪犯,实行社区矫正,就是将被判处管制的罪犯在社区执行,即社区矫正的本质就是社区执行刑罚。

At present,there are five main views on the nature of community correction in academic circles,namely,the theory of community penalty execution,non imprisonment penalty execution,penalty execution and social welfare theory,implementation correction and provision of social services,and criminal execution theory.However,these views are not accurate enough to identify the nature of community correction.From the practice of community correction and Community Correction Law,the implementation of community correction for criminals who are controlled,suspended,paroled and temporarily executed outside prison is to execute the criminals sentenced to be controlled in the community,that is,the essence of community correction is the execution of punishment in the community.
