社区矫正视野下半开放式收容教养模式的构建

Construction of Semi-open Mode of Shelter and Rehabilitate System Based on Vision of Community Correction

我国收容教养制度是将未达刑事责任年龄的未成年人统一进行教育、感化与挽救的保护处分手段。但自实施以来却逐渐形成以剥夺未成年人人身自由为主的变相刑罚体系,封闭性的执行模式、混合型的关押方式和不灵活的关押期限易使未成年人与社会相脱节,不利于未成年人的改过自新与预防犯罪。收容教养制度的完善可立足社区矫正视野,在人身危险性等级、适用对象种类的分级分类前提下,借鉴社区矫正机构工作人员、社会工作者、社区矫正监管模式、教育帮扶手段等一系列社会化内容,构建一种半开放式收容教养新模式,达到未成年人顺利回归社会的最终目的。

Shelter and rehabilitate system in China unifies the minors under the age of criminal responsibility and takes education,probation and rescue to them.However,since its implementation,this system gradually formed a disguised penalty system focusing on depriving minors of their personal freedom.Closed execution mode,mixed detention,inflexible detention period are likely to disconnect minors from society easily,which is harmful to minors’reformation and crime prevention.The improvement of the shelter and rehabilitate system can be based on the vision of community correction,under the premise of classification and classification of personal hazard levels and applicable object types.By drawing lessons from a series of socialized content such as community corrections institution staff,social workers,community corrections supervision model and education,a new mode of semi-open mode of the shelter and rehabilitate system could be constructed,and the ultimate goal of a successful return to society could be achieved.
