从检察民事公益诉讼视角探索野生动物保护

Exploration of Wildlife Protection from the Perspective of Procuratorial Civil Public Interest Litigation

我国由检察机关提起民事公益诉讼既具有一定的理论和实践基础,又体现了检察机关的内在职责,检察民事公益诉讼具有可行性与正当性。在野生动物保护方面,我国立法上野生动物保护相关法律制度需要完善,司法上野生动物保护是否属于检察民事公益诉讼的受案范围尚存争议,执法上相关部门执法较为分散,未做好与司法的联动。随着野生动物保护因新冠肺炎疫情成为社会普遍关注的问题,需要从新的视角探索野生动物保护。目前野生动物保护领域的检察民事公益诉讼面临着检察机关诉讼主体地位不明,诉前程序、调查取证、执行等程序存在缺陷等问题,因此应该明确人民检察院在民事公益诉讼中的原告地位,充分发挥诉前程序的作用,分散调查取证的压力并落实执行程序,发挥出检察民事公益诉讼在野生动物保护领域的最优作用。

The civil public interest litigation initiated by procuratorial organs has a certain theoretical and practical basis,and reflects the internal responsibilities of the procuratorial organs in China.In terms of wildlife protection,the relevant legal system of wildlife protection needs to be improved in legislation.Besides,there are still some disputes on whether wildlife protection belongs tothe scope of public interest litigation in the procuratorial field.The law enforcement of relevant departments is relatively scattered,and there is no good connection with the judiciary.Due to the novel coronavirus pneumonia epidemic,the wild animal has become a common concern in the world,and animal protection needs to be explored from a new perspective.At present,the procuratorial civil public interest litigation in the field of wildlife protection is faced with such problems as the unclear subject status of the procuratorial organ,the defects in the pre-litigation procedure,investigation and evidence collection,and execution procedures.Therefore,we should clarify the plaintiff status of the people’s procuratorate in the civil public interest litigation,fully make use of the pre litigation procedure,disperse the pressure of investigation and evidence collection,and implement the implementation of procedure.Thus,the function of civil public interest litigation is given to full play in the field of wildlife protection.
