摘要 《中华人民共和国民法典》(以下简称《民法典》)肯定了农村承包地"三权分置"的改革成果,吸纳了《农村土地承包法》的相关规定,在第十一章"土地承包经营权"中增设了土地经营权。土地经营权的权利属性依据经营主体、流转期限等不同,或为物权性权利或为债权性权利;相应地,前者的融资担保方式为抵押,后者则为权利质押。《民法典》肯定了流转期限5年以上的土地经营权的物权属性及其不动产登记能力,并将其登记效力规定为登记对抗主义。 The Civil Code of the People’s Republic of China(hereinafter referred to as The Civil Code) affirmed the reform achievements of the"separation of rights"of rural contracted land, absorbed the provisions of the Rural Land Contract Law, and the right of land management is added in Chapter 11 "the Right of Contracted Management of Land". The right attribute of land management right was either real right or creditor’s right according to the main body of management and the time limit of circulation. Accordingly, the financing guarantee of the former is mortgage, while the latter is pledge of rights. The Civil Code affirmed the real right attribute and the real estate registration ability of the land management right with a circulation period of more than five years, and stipulated its registration effect as the registration antagonism.
