C2C在线短租商业模式的法律问题探析

随着电子商务产业的欣欣向荣,在线短租这一崭新的商业模式开始进入人们的视野,而2019年《电子商务法》的生效,也标志着在线短租正式步入规范化的行业治理轨道。就C2C模式而言,在线短租平台的私法属性没有改变,本质上仍属于房屋租赁中的商事居间者。应以《电子商务法》的概括性布局为基本点,从完善配套制度体系、构筑行业自律机制、加快信用体系建设三方面入手,为化解外部性风险、避免行业内生隐患提供整体化方案。

With the flourishing of e-commerce industry,online short-rent—a brand-new business model,has begun to enter people’s vision.The entry into force of the Electronic Commerce Law in 2019 also marked that the online short-rent industry has formally entered into a standardized governance track.As far as C2C model is concerned,the private law attribute of online short-rent platform has not changed,and it is essentially still a commercial intermediary in housing leasing.Besides keeping regulation of private law,we should strengthen the macro-regulation construction based on the general layout of the Electronic Commerce Law.In other words,to provide a holistic scheme for resolving externalities and avoiding endogenous risks in the industry,we should start with perfecting the supporting system,building industry self-discipline mechanism and speeding up the construction of credit system.Finally,we can realize the blueprint of the modernization of the national governance system.
