摘要
无论对于南北经济协调发展,还是北方尤其是西北地区生态保护而言,黄河流域的治理和治理能力现代化都需要国家立法层面提供更多的制度供给,但国家层面的黄河立法面临诸多困难,需要发挥地方立法的灵活性和积极性,为国家立法进行先行先试。尤其是通过区域协同立法的方式,扩大地方立法经验的样本范围,在生态保护和高质量发展方面,在与上位法不冲突和保障国家法制统一的前提下,满足黄河流域经济社会发展对法治的迫切需求,需要进一步完善体制和机制,以重点领域和核心问题为突破,实现"以法治黄"的目标。在实现这一目标的过程中,需要树立"流域治理"的理念,将流域治理纳入国家治理的大框架中,丰富和完善国家治理的层次和体系构成,推进流域治理现代化。
Regardless of the coordinated development of the north-south economy or the ecological protection of the north,especially the northwest region,the governance and modernization of the governance capacity of the Yellow River Basin require the national legislative level to provide more institutional supplies.However,the national level of the Yellow River legislation faces many challenges.It is necessary to give full play to the flexibility and enthusiasm of local legislation,and conduct first tests for national legislation,especially through regional coordinated legislation to expand the sample range of local legislative experience.In terms of ecological protection and high-quality development,the premise of not conflicting laws and guaranteeing the unification of the national legal system,to meet the urgent needs of the rule of law for the economic and social development of the Yellow River Basin,it is necessary to further improve the system and mechanism,breakthrough key areas and core issues,and achieve the goal of rule of law by law.In the process of achieving this goal,it is necessary to establish the concept of"watershed governance",incorporate watershed governance into the framework of national governance,enrich and improve the level and system of national governance,and promote the modernization of watershed governance.
