显学抑或绝学——法律史学科百年发展周期律研究

Prestigious Study or Lost Study--Research on the Cyclical Law of the Centennial Development of the Legal History Discipline

中国法律史学科的百年发展及其在“显学”和“绝学”间的变动循环,深层次上涉及到法律史学科发展的周期律问题。以周期律作为理论分析工具,纵观中国法律史学科百年曲折发展历程,其大致经历了三个周期的动态循环,即清末民国的半个世纪首次经历由“显学”到“绝学”的变化,改革开放前30年再次经历由“显学”到“绝学”的过程,而改革开放后40年法律史学科正在经历第三次由“显学”到“隐学”再到“边缘化”的周期发展。进入新时代,法律史学人必须敏锐地认清学科发展的周期律,把握学科发展机遇期,促进法律史学科再现辉煌。

The century-old development of the Chinese legal history discipline and its cyclical changes between "prestigious study" and "lost study" involve the cyclical law of the development of the legal history discipline on a deep level.With the cyclical law as a tool of theoretical analysis,the research shows that the development of the Chinese legal history discipline over the past century has roughly experienced three dynamic cycles,that is,the change from "prestigious study" to "lost study" in the first half century from the late Qing Dynasty to the Republic of China,the change from "prestigious study" to "lost study" during the thirty years before the reform and opening up,and the third cycle of development from "prestigious study" to "obscure study" and to "marginalized study" during the 40 years after the reform and opening up.In the new era,scholars of legal history must have a keen understanding of the cyclical law of the discipline development,grasp the opportunities for the discipline development,and promote the revival of the legal history discipline.
